In accordance with applicable data protection legislation, including GDPR, VPS-Server.dk has implemented sufficient changes to the system that optimize how we collect data.

The purpose of this text is to document what data VPS-Server collects and what the purpose of the collection, including the processing of the data, is.

All subcontractors that VPS-Server cooperates with have data processing agreements with, if they are within the EU. We also document our work process for the provision, rectification, anonymization and deletion of data for users.

VPS-Server's has appointed the Executive Board of VPS-Server ApS to be the data controller. Questions can be sent, as well as contact with the Executive Board at support@vps-server.dk

No data protection officer has been appointed, as the special conditions of the EU General Data Protection Regulation Art. 37 (1) b-c do not apply to VPS Server

VPS-Server ApS is a company that sells hosting services. The purpose of collecting data about the customer is to be able to identify who the customer is, so that VPS-Server's can identify the person in case there should be hosted illegal material under Danish law, where information could be provided to the Danish government for further investigation.

There is also a need for customer information that follows support provided to the customer, where the data is used as an aid to best provide support to the customer.

Visitor information is also collected in order to optimize pages with poor call-to-action, as well as content on the page.

The personal data of VPS-Server’s employees is treated with confidentiality and the company is subject to a duty of confidentiality in accordance with data protection legislation.

Employees’ access to sensitive personal data is also limited, so that the employee only has the necessary rights to be able to fulfill the delivery obligations to the customer. The employee is also informed that they may only request personal data in the system if it is necessary in order to solve their task. Logging of such posts is logged and sample checks are taken, where the employee must account for their posts.

If there is a breach in our security protocol, systems or the like where personal data is stored or processed, VPS-Server will immediately notify the customer, without undue delay.

In addition, the Danish Data Protection Agency will be notified within 72 hours of discovery, if deemed necessary in accordance with the General Data Protection Regulation.

Information on the retention of personal data
If a customer wants to know what personal data is stored about them, as well as what processing purposes are associated, this can be read for any person on our website.

Should any questions arise in this regard, we make ourselves available and respond to emails on a regular basis.

Transfer of data
The customer has the right to receive all data associated with the customer’s account. In order to obtain its data, we must be able to identify the customer, against the information we have in the system. Here, the customer will be asked to provide their name, address, e-mail and the last 4 digits of their payment card used when purchasing a service.

VPS-Server will then start collecting the information about the customer, after which it will be stored in a zip file, which is encrypted with AES-256 encryption or stronger. The Zip file will then be sent by email to the customer’s email, which is on the customer’s profile in the system.

The code can either be sent via text message, physical letter or told via a phone call, however, the customer must re-verify themselves by this action.

Right to rectification The registered user has the right to update incorrect or directly misleading information at any time. The request is made via the peson contacting VPS-Server’s data controller, verifying itself with name, address, e-mail and the last 4 digits of its payment card, which is used when purchasing a service, and then stating What changes need to be made.

The data controller will then have this information corrected without undue delay and then confirm this to the registered user.

Right to erasure Every customer has the right to have the data stored about them by VPS-Server deleted, unless the information is required to comply with applicable legislation.

The request is made via the peson contacting VPS-Server’s data controller, verifying itself with name, address, e-mail as well as the last 4 digits of its payment card, which is used when purchasing a service.

The data controller will then without undue delay delete information in the VPS-Server database, as well as contact the company’s sub-processors to delete information in their system.

VPS Servers has the right to change the terms and prices of the services provided at any time. VPS Servers makes sure to update the servers with the latest updates, no later than 24 hours after they are released, so that security holes and errors are minimized. This is subject to force majeure. VPS Servers ensure minimal downtime. Should an accident occur, VPS Servers will decide on compensation. However, the customer cannot claim compensation against VPS Servers. VPS Servers reserves the right to move its services to other physical hardware and change the customer’s IP. All services of VPS Servers are subject to Danish law.

The beginning of the rental period of one of VPS Server’s services begins when the service is created and started. After the service has been used, the service is non-refundable. If the service is not used, reference is made to 4.

If the customer wishes to upgrade their service, the price difference for the missing rental period will be calculated and invoiced for the current service and the upgraded service respectively. Once the invoice is paid, the service will be upgraded. Downgrading of a service can be done at the earliest at the next payment and must be done with at least 5 days notice.

When purchasing a dedicated server or a virtual machine, a binding agreement is entered into between the customer and VPS Servers. The agreement is valid for the period of the rental agreement. At the end of the rental period, the customer decides whether the rental agreement should be extended or whether the agreement and the product expire. The customer can renew the rental agreement up to 5 days after the end of the rental period. After 5 days, the product and all content will be deleted.

Misuse of VPS Servers services, such as DDoS attacks and hacking will result in immediate closure of servers without the possibility of a refund. Further police reports of the abuse and an investigation into the extent of the case will be launched. VPS Servers will also issue an invoice to the customer of a minimum of 5. 1000 kr. Depending on the level of abuse.

VPS Servers prices have valid Danish VAT of 25%.

VPS Servers is not responsible for the customer’s use of VPS Servers services. Furthermore, VPS Servers does not assume responsibility for data or content on the customer’s product. The customer is responsible for what data is stored and stored on the customer’s product. It is therefore the customer’s responsibility if illegal and/or infringing material is stored.

When purchasing services from VPS Servers, an invoice is issued. The invoice contains the current price for the purchase. VPS Servers provides a 14-day right of withdrawal, however, provided that the service is not used. The invoice must be paid within 5 days. If the invoice is not paid within these 5 days, the service will be deleted. When extending services, please refer to 1 for VPS Servers different services. It is the customer’s responsibility to extend a service before expiry.

VPS Servers maintain the servers the virtual machines run. VPS Servers have the right to use up to 48 hours for updates. These hours are not included in the uptime. Dedicated servers do not maintain VPS Servers. This is the customer’s own responsibility.

If the customer violates the applicable rules and laws, VPS Servers will give a warning via email. In case of repeated violations, VPS Servers reserves the right to withdraw the service without the right to compensation. In case of serious infringement, reference is made to 1. 4.

VPS Servers does not disclose information to third parties. All information between VPS Servers and the customer remains confidential between the parties. If the customer wants full insight into the information VPS Servers has stored about the customer, the customer is entitled to this according to the Danish Personal Data Act. VPS Servers keeps all information for at least 5 years.

VPS Servers has no liability for lost data.

VPS Servers deliver purchased services as quickly as possible. In general, delivery will take place within a few minutes. However, in case of technical difficulties or payment problems, VPS Servers reserves the right to postpone the creation.

When using services purchased from VPS Servers, the customer waives the right to the 14-day right of withdrawal. This means that the service is non-refundable. If VPS Servers are to blame for long delivery times or have an impact on performance, exceptions may be made in some cases.

VPS Server’s various services are provided on different servers. The terms of delivery may therefore be different and reference is therefore made to 1. 3. After commissioning of the service provided by VPS Servers, the delivery is accepted by the customer.

Automatic subscription payment automatically renews services when there is one day left of the current rental period. If the customer wishes to unsubscribe from automatic subscription payment, this can be done via the user panel or by written notice to VPS Servers via e-mail or support ticket. A cancellation must be made before the server is renewed.

At VPS-Servers we know how much security means to you as a customer when you shop services and products online. Therefore, we have set very strict requirements for our suppliers who carry out the withdrawal of the amount on your card.
Specifically, we have chosen to use Quickpay and Stripe as PSP (payment service provider), which is responsible for hosting and operating our payment window. Quickpay and Stripe are PCI DSS certified which means that they meet even the strictest requirements when it comes to card payments. Quickpay and Stripe are therefore responsible for hosting the payment window, which takes place on their servers, behind their firewalls which are regularly secured. Quickpay and Stripe send information about payments made to our system via a highly encrypted connection, after which VPS-Servers processes the data.
In the event that a payment is flagged by our automated fraud system, the payment will be processed through 3d Secure, Verifyed by VISA or MasterCard SecureCode, to confirm that the payment comes from the card’s maintainer. We do this to reduce card fraud.

The entire VPS-Servers uses SSL encryption, which means that the visitor to our website connects to our server via an encrypted connection. This means that there is no middleman who can look in the traffic between the visitor and the server. However, should a 3 party get hold of the connection data, they will not be able to read them as they are encrypted.
